Bend police released more details this afternoon on a Awbrey Butte home break-in that took a deadly turn late Saturday night.

Police said that 33-year-old Shane Michael Munoz of Bend was shot and killed during an altercation with homeowner Kevin Marshall Perry.

According to police, Perry returned home around 12:30 a.m. Sunday morning accompanied by Amanda Weinman of Eugene to find the front door of Perryโ€™s Awbrey Butte residence had been forced open. Perry and Weinman reportedly found Munoz in the living room of the home where a struggle ensued. According to police, Perry shot Munoz during the skirmish. When police arrived at the scene, Munoz was already dead.

Police have already executed a search warrant for Perryโ€™s home but have not arrested Perry in relation to the shooting.

Police said the case remains under investigation.

As reported by the Source recently, Oregon is among the states that offer broad protections to home/gun owners who are deemed to be defending themselves, a concept that is referred to as the Castle Doctrine but extends outside the home in states like Oregon that have adopted or otherwise codified “Stand Your Ground” laws.

  1. If you see your front door kicked in….do you go inside? I would not! Didn’t the police ask Zimmerman in Florida to stop and let the police show? I say the homeowner kicked in his own front door! How does a woman get minor injuries also? HHhhmmmm, did Perry allow his girlfriend to enter, knowing a front door was kicked in? Sorry but it doesn’t add up! Shane was not a stranger to either friend, and hopefully the girl steps to the plate and at least tells her story without any hesitation from Perry!
